Copyright Complaints
How to tell us that something on a site we host infringes your copyright, and how a client answers a complaint they believe is wrong.

1. Our position
We respect copyright and we expect our clients to. If material on a site we host infringes your copyright, tell us and we will act on it.
We also do not take a client's website down on the strength of an email that asserts nothing in particular. The process below is what the Digital Millennium Copyright Act asks for, and following it is what lets us act quickly.
2. Sending us a notice
Send notices to support@alamo-digital.com with "DMCA Notice" in the subject line.
To be effective, a notice must include all of the following:
- Your physical or electronic signature.
- Identification of the copyrighted work you say has been infringed.
- The URL of the specific material you say is infringing, precise enough for us to find it.
- Your name, address, telephone number, and email address.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.
Misrepresenting that material is infringing can make you liable for damages, including costs and legal fees, under 17 U.S.C. § 512(f). This is not a form to send lightly.
3. What we do with it
- We review the notice for the elements above.
- If it is complete, we remove or disable access to the material promptly.
- We tell the client whose site it is what we removed and why, and forward them the notice.
- We tell you what we did.
4. If you are the client and you believe the notice is wrong
You can file a counter-notice. Send it to the same address with "DMCA Counter-Notice" in the subject line, including:
- Your physical or electronic signature.
- Identification of the material that was removed, and where it was before removal.
- A statement, under penalty of perjury, that you believe in good faith it was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement consenting to the jurisdiction of the federal court for the district where you live (or, if outside the United States, of a district where we may be found), and that you will accept service of process from the complainant.
If we receive a valid counter-notice, we forward it to the complainant. Unless they tell us within 10 to 14 business days that they have filed a court action, we may restore the material.
5. Repeat infringers
We terminate hosting for clients who repeatedly infringe copyright. What counts as repeated is our judgement, applied to the circumstances.
